Booking Conditions

These Conditions apply to tours, accommodation, transfers and other travel services booked through sativa.com.tr or the communication channels of Sativa Tour & Travel.

1. Scope and contractual documents

These Conditions govern daily tours, overnight tours, boat tours, transfers, activities and other travel-service reservations provided by the Company.

The contractual framework consists of:

  • The reservation summary and selected service details;
  • The Pre-Contract Information Form;
  • The Distance Sales Agreement;
  • The Cancellation, Refund and Amendment Conditions;
  • These Booking Conditions;
  • Any additional service-specific conditions clearly disclosed before booking.
Nothing in these Conditions excludes or restricts mandatory consumer rights under Turkish law.

2. Booking and confirmation process

1. Select the service and date The customer selects the tour, travel date and participants.
2. Provide booking information Accurate customer, participant and contact information is entered.
3. Review and confirm the documents The consumer reviews and separately confirms the mandatory documents.
4. Complete or verify payment Payment is completed or the bank transfer is verified by the Company.
5. Receive confirmation The reservation number, summary and contractual documents are supplied electronically.
Submitting a form or booking request does not by itself create a confirmed booking. Confirmation requires availability, completion of the contractual confirmations and receipt or verification of the required payment.

3. Accuracy of booking information

The person making the reservation is responsible for ensuring that names, dates of birth, contact details, billing information and other required information are accurate and current.

A person booking for other participants confirms that they are authorised to provide the required information and will communicate the contractual and safety information to those participants.

Consequences arising from inaccurate or outdated information will not be attributed to the Company to the extent that the Company is not at fault.

4. Prices, payment and bank-transfer time limit

  • The total price, including taxes and approved additional services, is displayed before payment.
  • No optional service or charge may be added without the consumer’s express approval.
  • Included and excluded services are stated on the service page and booking summary.
  • Promotions remain subject to their announced dates, capacity and conditions.
One-hour bank-transfer period: Payment or a valid payment notification must be completed within one hour after a bank-transfer reservation is created. Otherwise, the reservation may be cancelled and the allocated capacity released.

The reservation number should be entered in the payment description. A payment notification is not, by itself, confirmation that the funds have reached the Company’s account.

5. Children and age conditions

  • Children who have not reached the age of 7 participate free of charge in daily and overnight tours.
  • Participants aged 7 or over are charged the advertised full participation price.
  • The correct date of birth must be supplied and may be verified using an appropriate document.
  • Children remain included in the vehicle, boat and overall participant capacity even where participation is free.
  • Children must remain under the supervision of a parent or legal representative.

Optional services requested by the customer, such as a special room or additional bed not included in the advertised standard service, may only be charged after the price is disclosed and separately approved.

6. Consumer cancellation and refunds

Cancellation requests must contain the booking holder’s name, reservation number and an unequivocal cancellation statement and must be sent in writing or by a durable medium to oykuislekler@gmail.com .

The time at which the notice reaches the Company’s system, according to Türkiye time, determines the applicable cancellation period.

Dated tours, accommodation, transport and leisure services fall within the exceptions to the general 14-day withdrawal right under the Turkish Distance Contracts Regulation. The cancellation rights above are contractual rights granted by Sativa.

7. Changes requested by the customer

Requests to change the tour date, participant, service or reservation scope must be submitted in writing as early as possible.

Requests remain subject to:

  • Availability on the requested tour or date;
  • Transport, accommodation and supplier conditions;
  • The current price and service scope on the new date;
  • Applicable travel and safety requirements.

Any price difference or unavoidable supplier cost will be disclosed before the change. No change will be completed and no additional amount charged without express approval.

If a change cannot be accepted, the existing reservation remains valid. If the consumer then cancels, the cancellation conditions applicable when the notice is received will apply.

8. Cancellation by the Company

If the Company cancels the tour or booked service, the amount paid for the affected service will be refunded in full.

An equivalent or higher-value alternative date or service may be offered, but the consumer is not required to accept it. If the alternative is refused, the consumer retains the right to a full refund.

If an accepted alternative has a lower price, the difference will be refunded. A higher-priced alternative does not create an additional payment obligation without express approval.

9. Weather, competent authorities and force majeure

If a boat tour cannot operate because of a decision of the Harbour Master, Coast Guard or another competent authority, adverse weather or sea conditions, or safety considerations, the amount paid for the affected tour will be refunded in full.

Earthquakes, fires, floods, epidemics, war, official decisions, transport closures and comparable events outside the parties’ reasonable control will be evaluated according to their circumstances, service feasibility, recoverable supplier payments and mandatory law.

A participant relying on personal force majeure may be asked to provide a verifiable document showing that the event directly prevented participation.

Nothing in this section removes mandatory statutory refund, compensation or complaint rights.

10. Participant responsibilities

Participants must:

  • Arrive at the meeting point on time;
  • Carry all required identity, passport, visa and travel documents;
  • Disclose relevant health, mobility, allergy, pregnancy or assistance requirements before booking;
  • Follow safety instructions issued by guides, captains, drivers, facilities and competent authorities;
  • Respect the safety and comfort of other participants;
  • Supervise participating children;
  • Avoid damage to the environment, cultural heritage, vehicles, boats and facilities.

11. Programme and service changes

The order of the programme, departure time, route or equivalent supplier may be changed because of weather, road conditions, safety, decisions of competent authorities or compulsory operational arrangements.

Reasonable care will be taken not to reduce the essential nature or value of the service. If a material adverse change is required, the consumer will be informed through a durable medium and granted the applicable statutory options.

12. Personal data and dispute resolution

Personal data collected during booking is processed under Turkish Personal Data Protection Law No. 6698 for booking and service performance, communications, payments, accounting, security, legal compliance and dispute management.

Marketing permission is not a mandatory condition of booking and must be presented as a separate optional choice.

Subject to annually applicable monetary thresholds, consumers may apply to the competent Consumer Arbitration Committee or Consumer Court at their place of residence or where the consumer transaction was concluded.
