2. Definitions and Subject

This Agreement governs the remote booking, sale and performance of the dated tourism service selected by the Buyer through sativa.com.tr.

The Pre-Information Form, booking summary, tour/service programme, payment record and transaction-specific conditions form an integral part of this Agreement. Nothing herein limits any mandatory consumer right that cannot lawfully be waived.

4. Formation of the Agreement

Before becoming liable for payment, the Buyer is provided with the Pre-Information Form, this Agreement, the booking summary and the applicable cancellation conditions in a clear electronic format. Mandatory checkboxes must not be preselected.

The Agreement is formed when the Buyer separately confirms the required documents, activates the button clearly indicating a payment obligation, and the transaction is recorded by the system. Marketing consent is separate, optional and is not a condition of booking.

5. Price and Payment

The total price is {{CURRENCY}} {{GRAND_TOTAL}}, including applicable taxes. The selected payment method is {{PAYMENT_METHOD}}.

Payment through iyzico

Where card payment is selected, the transaction is processed through the iyzico payment infrastructure. The payment institution or issuing bank may request additional authentication depending on the transaction.

6. Electronic Delivery and Performance

Tourism services do not involve the delivery of physical goods. Booking confirmation, agreements, payment confirmation and any voucher or ticket are delivered electronically to the email address supplied by the Buyer or through another appropriate durable medium.

The service is performed on the dates and subject to the route, meeting point and essential characteristics stated in the booking summary. Any material change is notified to the Buyer, without prejudice to mandatory consumer rights.

7. Right of Withdrawal

This statutory exception does not remove the contractual cancellation rights set out below or any mandatory remedy arising from defective, incomplete or non-performed services.

8. Cancellation and Refund Rules

Cancellation requests must be sent through a durable medium to oykuislekler@gmail.com, stating the reservation number and Buyer details. The time the request reaches the Provider’s records determines compliance with the relevant deadline.

9. Child Pricing

• Children under seven years of age are free of charge on both day and accommodation tours.
• Participants aged seven or over are charged the full applicable price.

Age is calculated as of the service start date. Identification may be requested. Any mandatory capacity or safety restriction imposed by a hotel, carrier or other service provider remains applicable and must be disclosed before payment where transaction-specific.

10. Cancellation by the Provider or Public Authority

An alternative date may be selected only with the Buyer’s separate agreement. Rescheduling is not compulsory and does not remove the Buyer’s right to a full refund.

11. Force Majeure

Natural disasters, epidemics, war, terrorism, strikes, closure of transport routes, official decisions and comparable unforeseeable events beyond the parties’ reasonable control may constitute force majeure.

Documented requests are assessed case by case, taking into account the nature of the event, recoverable third-party costs and mandatory legislation. Non-waivable consumer rights remain reserved.

12. Obligations of the Parties

The Provider must perform the service in accordance with its disclosed essential characteristics, provide the contractual documents through a durable medium, and notify the Buyer of material changes or cancellations.

The Buyer must provide accurate identity, contact and participant information; obtain required passports, visas, permits and travel documents; arrive at the meeting point on time; comply with safety instructions; and disclose relevant health or accessibility requirements before booking.

13. Personal Data

Personal data is processed in accordance with Turkish Law No. 6698 for contract formation and performance, payment, accounting, customer support, legal compliance and the establishment or protection of rights.

Data necessary for payment may be transferred to iyzico, while limited data required for performance may be shared with the relevant hotel, carrier, boat operator, guide or other service provider. Further information is available in the Data Protection Notice and Privacy Policy.

14. Complaints and Dispute Resolution

Consumers may apply to the competent Turkish Consumer Arbitration Committee or Consumer Court according to the monetary jurisdiction limits and venue rules in force. Mandatory mediation and other procedural rules remain reserved.

The Turkish version governs transactions subject to Turkish law. This English version is supplied for information and accessibility; mandatory rights applicable to foreign consumers remain unaffected.
