1. Acceptance and scope

By accessing or using sativa.com.tr, visitors and users acknowledge that they have read these Terms and agree to use the website in accordance with them.

These Terms regulate website use. Where a tour, accommodation, transfer or other travel service is purchased, the Pre-Information Form, Distance Sales Agreement, Reservation Conditions, Cancellation and Refund Conditions and any service-specific terms presented before the transaction will also apply.

2. Website services

Services remain subject to availability, capacity, weather and sea conditions, decisions of competent authorities, operational feasibility and service-specific conditions.

3. User obligations

Users must:

• Provide accurate, current and complete information;
• Not use another person’s identity or contact details without authority;
• Use the website lawfully and in good faith;
• Not interfere with website operation or security;
• Not introduce malware or conduct automated attacks or unauthorised scanning;
• Not manipulate reservation, pricing or promotion mechanisms;
• Respect the rights of other users and third parties;
• Not submit unlawful, misleading, threatening or infringing content.

Systematic scraping, copying or collection of website content by bots, crawlers or comparable automated tools for the creation of a commercial database is prohibited without prior written permission.

4. Account and password security

Certain features may require a user account. Users are responsible for the accuracy of their account information and for keeping passwords, verification codes and access credentials confidential.

Suspected unauthorised use or security breaches must be reported to the Company without undue delay. The Company may request additional verification to protect account security, prevent misuse or comply with legal obligations.

5. Reservations, prices and payments

Completing a form or submitting a reservation request does not, by itself, constitute a confirmed reservation. Confirmation is subject to availability, conclusion of the applicable agreements and completion or verification of the selected payment method.

• Prices are displayed in Turkish lira and include applicable taxes unless stated otherwise.
• Included and excluded services are specified on the relevant service page.
• Displayed amounts may be verified against current server-side records.
• Manifest technical pricing errors may be corrected subject to mandatory consumer law.
• Promotions may be limited by dates, capacity and specific conditions.

6. Travel content, images and updates

The Company exercises reasonable care to keep website information accurate and current. Programme times, routes, departure points, vehicles, boats, accommodation facilities and suppliers may nevertheless change due to operational requirements or decisions of competent authorities.

Photographs and videos are illustrative. Conditions may differ because of season, weather, lighting, sea conditions, the natural environment or third-party service providers.

Users with a specific requirement that affects their purchase decision should obtain written confirmation before booking.

7. Intellectual and industrial property

Website designs, software, source code, databases, text, graphics, photographs, videos, logos, trade marks, domain names and other content belong to the Company or the relevant rights holders and are protected by applicable law.

Users receive only a limited, non-transferable and non-exclusive right of access for personal, non-commercial use. Without prior written permission, content may not be:

• Commercially reproduced or published;
• Modified, sold, licensed or distributed;
• Systematically transferred to another website or database;
• Used after removing trade mark or source information;
• Reverse engineered, decompiled or otherwise converted into source code.

8. User-submitted content

Where users submit reviews, images, messages or similar material, they confirm that the content is lawful, that they hold the necessary rights and permissions and that it does not infringe privacy, personality, copyright or trade mark rights.

The Company may refuse, remove or report content that is unlawful, misleading, promotional, abusive, discloses personal data, creates a security risk or breaches these Terms.

9. Third-party services and links

The website may contain links or integrations relating to maps, social media, communications, accommodation or other service providers. Their content, security, privacy practices and contractual terms are not under the Company’s control.

This does not affect the Company’s statutory or contractual responsibility for suppliers used directly in performing a travel service.

10. Availability and limitation of liability

The Company applies reasonable technical and administrative measures to keep the website secure and available. Temporary interruptions may occur because of maintenance, updates, internet infrastructure, hosting services, cyber incidents, power failures or force majeure.

Subject to liability that cannot legally be excluded, including liability arising from intent, gross negligence and mandatory consumer law, the Company is not responsible for consequences caused by the user’s device, connection or own security deficiencies.

11. Personal data, privacy and cookies

Personal data is processed in accordance with Turkish Personal Data Protection Law No. 6698 and applicable legislation. Further information is available in the:

Non-essential cookies are not activated before the required visitor preference has been obtained.

12. Restriction or termination of access

The Company may temporarily or permanently restrict access in cases involving security risks, suspected fraud, unlawful use, unauthorised access, interference with the system or a material breach of these Terms.

Such action does not remove mandatory consumer rights arising from an existing valid reservation.

13. Amendments, governing law and disputes

The Company may update these Terms to reflect changes in law or website functions. The current version will be published with its effective date and version number. Changes will not be applied retrospectively to completed transactions to the consumer’s detriment.

These Terms are governed by the laws of the Republic of Türkiye. Consumers may apply to the competent Consumer Arbitration Committee or Consumer Court at their place of residence or where the transaction was concluded, subject to applicable jurisdictional and monetary limits.

For disputes that do not constitute consumer transactions, the Courts and Enforcement Offices of Kaş/Antalya shall have jurisdiction, subject to mandatory jurisdiction rules.
